Please read these Terms of Service ("Terms") carefully before using the mobile application Clapback - Win Every Debate (the "Application" or "Service").
These Terms form a binding agreement between you ("User," "you") and Clapback - Win Every Debate ("Company," "we," "us").
By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy.

Definitions
AI Service: the Company’s use of the OpenAI GPT4o API (and successors) to generate fact-checked, source-backed rebuttals and related text for Users.
OCR Service: the text-extraction feature that processes User-supplied screenshots or social links through third-party optical-character-recognition providers like Jina AI.
Clapbacks: the monthly quota of rebuttals a User may generate under their current Subscription Plan.
Subscription Plan: a recurring in-app purchase that grants a specified number of Clapbacks per billing period.
Application Store: Apple App Store or Google Play Store, as applicable.
Device: any mobile phone, tablet or other device that can access the Application.

Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

Subscription Plans
Plans & Pricing:
- Free: 5 Clapbacks per month, no charge.
- Basic: US $5 per week, 15 Clapbacks per month.
- Pro: US $10 per week, unlimited Clapbacks.

Auto-Renewal: Paid plans renew automatically through the Application Store unless cancelled at least 24 hours before the end of the current period.
Usage Limits: When you have used all available Clapbacks, further rebuttal requests are blocked until the next billing cycle or until you upgrade your plan.
Refunds: All purchases are final and handled solely by the Application Store’s refund policies.

User Content
Ownership: You retain all rights in screenshots or text you upload ("User Content"). You grant the Company a non-exclusive licence to process that content solely to provide the AI and OCR Services.
Prohibited Content: You agree not to upload content that is illegal, harassing, hateful, or infringes third-party rights, including copyright.
Copyright Complaints: If you believe the Service processes material that infringes your copyright, email support@clapbackapp.online. with (i) your contact details, (ii) a description of the copyrighted work, and (iii) the allegedly infringing material.

AI & OCR Disclaimer
The AI Service produces content automatically. While we strive for accuracy, AI-generated text may be incorrect, outdated or incomplete. You agree to independently verify citations before relying on them and acknowledge that the Company is not providing legal, medical or professional advice.

End-User Licence
The Company grants you a limited, non-transferable, non-exclusive licence to install and use the Application on Devices you own or control, strictly in accordance with these Terms. You may not reverse-engineer, decompile or create derivative works from the Application.

Limitation of Liability
To the fullest extent permitted by law, the Company’s total liability under these Terms is limited to the lesser of (a) the amount you paid for the Service in the preceding month or (b) US $100.

Dispute Resolution & Arbitration
Informal Negotiations: You agree to contact us at support@clapbackapp.online. and attempt to resolve any dispute informally for at least 30 days before initiating arbitration.
Binding Arbitration: If unresolved, the dispute shall be submitted to binding arbitration under the AAA Consumer Arbitration Rules.
Class-Action Waiver: Disputes will be resolved only on an individual basis; class actions are not permitted.

Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States.
